The Trump administration has tightened immigration policy. Authorities can ask for your papers at any time. These are the documents you can show to demonstrate that you are in the country legally or what you should show if you are here undocumented.

In cases where the authorities detain you or ask for identification, these are the papers you should present.

Individual or families without documents

All undocumented immigrants have the right to present proof of identification .

Documents you can present:

Undocumented: any valid identification (driver's license, municipal ID card...)

Documents that must be up to date and readily available:

Recommendations in case of arrest:

  • Never present false documents.
  • Memorize the phone number of your attorney or a family member.
  • If you don’t have a lawyer, memorize the phone number of an organization that helps immigrants. You can find one using this search tool.
  • Don’t sign any official document.

Families with mixed status:

Families where some are undocumented and the children are legally in the country.

Documents that can be presented:

For undocumented: any valid document that identifies you (driving license, municipal ID card ...)

Those born in the US, or the children of naturalized foreigners.

Persons who have been granted a “Green Card.”

Temporary Visas

Individuals who have been granted a temporary visa to remain legally in the U.S. and, in some cases, to work or study.

Refugees and asylum seekers

Permission to remain in the United States for people who have been persecuted for reasons of race, religion, nationality or politics.

Temporary Protection Status (TPS)

Temporary humanitarian aid granted to citizens of the following countries: El Salvador, Guinea, Haiti, Honduras, Liberia, Nepal, Nicaragua, Sierra Leone, Syria, Somalia, Sudan, South Sudan and Yemen.

Documents that can be presented:

The DHS Secretary may designate a country to TPS because of the following temporary conditions:

  • Armed conflict in progress
  • Natural disaster or epidemic
  • Other extraordinary temporary conditions

Undocumented youth covered by DACA

Program that curbs the temporary deportation of immigrants who entered the U.S. as children. They are known as Dreamers.
