Gigantes con Don Francisco: Términos y condiciones
1. OVERVIEW
These Official Rules govern participation in the on-air games (each, a "Game," collectively, the "Games") conducted during the production and broadcast of "Gigantes con Don Francisco" and any related pre-show, livestream, post-show, or promotional programming (the "Program"). The Games are open only to individuals confirmed by TelevisaUnivision’s designated casting process to attend a Program taping as a member of the studio audience ("Participant(s)"). The Games are sponsored and administered by Univision Networks & Studios, Inc. ("TelevisaUnivision"), with principal offices at 9405 NW 41st St, Miami, FL 33178. Any reference to TelevisaUnivision includes its parents, subsidiaries, affiliates, production partners, and promotional agencies (collectively, the "Released Parties"). No purchase, payment, or fee of any kind is required to be cast, to attend a taping, or to participate in any Game, and no purchase will increase an individual’s likelihood of selection or of winning. Void where prohibited by law.
2. ELIGIBILITY
To be eligible to participate in any Game, an individual must, at all times through the taping of the Program:
• Be selected and confirmed by TelevisaUnivision’s designated casting contractor as a member of the studio audience for the applicable taping;
• Be eighteen (18) years of age or older at the time of the taping;
• Be a United States citizen or a lawful permanent resident of the United States, and be able to produce valid documentary proof of such status upon request (e.g., a valid U.S. passport, U.S. birth certificate, Certificate of Naturalization, or Permanent Resident Card);
• Not be an employee, officer, director, or agent of, or a contractor engaged by, TelevisaUnivision, its affiliates, the Program’s sponsors, or their respective advertising, promotion, or casting agencies, nor an immediate family member (spouse, parent, child, or sibling) or household member of any such person; and
• Have executed and delivered to TelevisaUnivision a fully completed Appearance Release (Casted Audience) (the “Participant Release”) and any other documentation
TelevisaUnivision may require prior to the taping. TelevisaUnivision reserves the right to verify eligibility, including citizenship or legal residency status, at any time before, during, or after a taping, and to disqualify any individual who does not meet, or whom TelevisaUnivision reasonably believes does not meet, the foregoing requirements, whether or not that individual has already been cast, has begun participating in a Game, or has been announced as a winner.
3. CASTING PROCESS
Members of the public may be identified and confirmed to attend a Program taping through TelevisaUnivision’s designated casting contractor(s). Casting is conducted at TelevisaUnivision’s sole discretion and is not a lottery, sweepstakes, or game of chance; selection to attend a taping does not guarantee selection to participate in, or win, any particular Game. TelevisaUnivision and its casting contractor(s) may request identifying and contact information, proof of eligibility (including proof of citizenship or legal residency), and other information reasonably necessary to confirm eligibility and coordinate attendance.
4. PARTICIPANT REQUIREMENTS
As a mandatory condition of participating in any Game, each Participant must execute and deliver to TelevisaUnivision the Participant Release prior to the taping. The Participant Release governs the use of a Participant’s name, image, likeness, voice, appearance, and biographical information in connection with the Program. Failure or refusal to sign the Participant Release, or any other documentation TelevisaUnivision may require, within the timeframe specified by TelevisaUnivision will result in the individual not being permitted to participate in any Game or appear on-air.
5. DESCRIPTION OF GAMES
During the taping, TelevisaUnivision may select Participants from the studio audience to play one or more of the following Games, at TelevisaUnivision’s sole discretion. The host will explain the detailed rules of play for each Game to Participants during the taping. TelevisaUnivision reserves the right to modify the format, mechanics, prize values, or order of play of any Game, including as necessitated by production requirements, provided that no such modification will adversely affect a Participant’s rights with respect to a Game already in progress. Not all Games are offered in every Program; the Games played, and whether a Vehicle Prize is available, may vary by Program as determined by TelevisaUnivision in its sole discretion.
(a) Lo Hace o No Lo Hace. A Participant predicts, across a series of up to five (5) questions of increasing value, whether the outcome of a video or image sequence presented by the host will occur. A Participant who answers incorrectly is eliminated and retains any amounts already won; then play passes to another audience member beginning with the next question. A Participant who answers all five (5) questions correctly wins $1,500, plus an additional $1,000 bonus, for a total of $2,500. The last Participant to answer correctly qualifies to play for a vehicle prize (the "Vehicle Prize") in a car Game as described below. Prizes for car Games are as set forth in Section 6 (Prizes).
(b) Dónde Fue y Cómo Fue. A Participant answers a series of up to five (5) multiple-choice questions of increasing value about an image or moment connected to the Program’s featured artist. A Participant who answers incorrectly is eliminated and retains any amounts already won; then play passes to another audience member beginning with the next question. A Participant who answers all five (5) questions correctly wins $1,500, plus an additional $1,000 bonus, for a total of $2,500. The last Participant to answer correctly qualifies to play for the Vehicle Prize in a car Game. Prizes for this Game are as set forth in Section 6.
(c) Sí o No. A Participant predicts how the Program’s featured guest artist answered a series of up to five (5) yes/no questions of increasing value that were prepared in advance of the taping. A Participant who answers incorrectly is eliminated and retains any amounts already won; then play passes to another audience member beginning with the next question. A Participant who answers all five (5) questions correctly wins $1,500, plus an additional $1,000 bonus, for a total of $2,500. The last Participant to answer correctly qualifies to play for the Vehicle Prize in a car Game. Prizes for this Game are as set forth in Section 6.
(d) Lo Que Más Le Gusta. A Participant attempts to identify the Program’s featured guest artist’s stated preference among three (3) options, across a series of up to five (5) questions of increasing value. A Participant who answers incorrectly is eliminated and retains any amounts already won; then and play passes to another audience member beginning with the next question. A Participant who answers all five (5) questions correctly wins $1,500, plus an additional $1,000 bonus, for a total of $2,500. The last Participant to answer correctly qualifies to play for the Vehicle Prize in a car Game. Prizes for this Game are as set forth in Section 6.
(e) Verdadero o Falso (True or False). The host presents a statement or situation concerning the Program’s featured guest artist together with three (3) options, of which two (2) are false and one (1) is true, and a Participant identifies the true option, across a series of up to five (5) questions of increasing value. A Participant who answers incorrectly is eliminated and retains any amounts already won; then play passes to another audience member beginning with the next question. A Participant who answers all five(5) questions correctly wins $1,500, plus an additional $1,000 bonus, for a total of $2,500. The last Participant to answer correctly qualifies to play the Vehicle Prize in a car Game. Prizes for this Game are as set forth in Section 6.
(f) La Frase Incógnita. One or more Participants, in turn, attempt to reveal a hidden phrase, title, or moment associated with the Program’s featured artist by requesting letters or attempting to solve. The available prize begins at a set amount and is reduced for each incorrect letter request or incorrect solve attempt. A Participant who solves the phrase wins the amount then remaining and qualifies to play for the Vehicle Prize in a car Game. Prizes for this Game are as set forth in Section 6.
(g) De Par en Par. Eligible Participants play for the Vehicle Prize by revealing spaces, in turn, on a game board containing, four (4) wheels, a number of "X" spaces, and a number of prize spaces. The wheels remain revealed and accumulate throughout the Game, regardless of which Participant uncovered them. Revealing a pair of the same prize space wins the corresponding prize. If a Participant reveals an "X," that Participant is eliminated and play passes to another eligible Participant, who continues on the same board. The Participant who reveals the fourth (4th) wheel wins the Vehicle Prize, regardless of which Participants revealed the previous three (3) wheels. If the third (3rd) "X" is revealed before the fourth (4th) wheel, the Participant who revealed that "X" is eliminated and the Game immediately ends without the Vehicle Prize being awarded. Revealing an "X" eliminates the Participant, who retains prizes won but forfeits the cash associated with any wheels revealed. A Participant may choose to stop playing before risking another selection and keep the cash accumulated from the wheels that Participant revealed during that turn. Prizes for this Game, including the Vehicle Prize, are as set forth in Section 6.
(h) Póngale Ruedas y Se Lo Lleva. Eligible Participants play for the Vehicle Prize by revealing spaces, in turn, on a game board of fourteen (14) spaces containing four (4) wheels, a number of "X" spaces, and a number of prize spaces. Each wheel revealed awards a cash amount and is added to the on-screen vehicle; a Participant who reveals the fourth (4th) wheel wins the Vehicle Prize. Revealing an "X" eliminates the Participant, who retains prizes won but forfeits the cash associated with any wheels revealed. If three (3) "X" spaces are revealed before all four (4) wheels, the Vehicle Prize is not awarded. Prizes for this Game, including the Vehicle Prize, are as set forth in Section 6.
(i) Lotería. A method by which one or more audience members are selected at random to play for the Vehicle Prize in a car Game. Each audience member is assigned a sequential number based on the number of attendees, and one number within that range is selected at random. This Game is a selection mechanism only and awards no separate prize.
6. PRIZES.
• Lo Hace o No Lo Hace: up to $2,500, plus a chance to play for the Vehicle Prize in a car Game.
• Dónde Fue y Cómo Fue: up to $2,500, plus a chance to play for the Vehicle Prize in a car Game.
• Sí o No: up to $2,500, plus a chance to play for the Vehicle Prize in a car Game.
• Lo Que Más Le Gusta: up to $2,500, plus a chance to play for the Vehicle Prize in a car Game.
• Verdadero o Falso (True or False): up to $2,500, plus a chance to play for the Vehicle Prize in a car Game.
• La Frase Incógnita: up to $3,000, plus a chance to play for the Vehicle Prize in a car Game.
• De Par en Par: cash and/or merchandise revealed during play, plus $1,000 for each wheel part revealed, plus a chance to win the Vehicle Prize, as described below. The five (5) prize pairs consist of: a Samsung Galaxy Tab S9 FE tablet (128GB, 10.9-inch; ARV approximately $299); a Nintendo Switch OLED video game console (ARV approximately $250 to $300); Sony WH-1000XM5 premium wireless headphones (ARV approximately $248 to $250); an Anker Nebula P1i portableprojector (ARV approximately $295 to $299); and an Apple Watch SE 3 smartwatch (GPS, 44mm; ARV approximately $279).
• Póngale Ruedas y Se Lo Lleva: cash and/or merchandise revealed during play, plus $1,000 for each wheel part revealed, plus a chance to win the Vehicle Prize, as described below. The Vehicle Prize, will have an approximate retail value (“ARV”) of $33,440.00, which may vary based on the make, model, trim, and dealer-installed options of the vehicle actually awarded.
In each Program, a Vehicle Prize (the car) is played for in a single final car Game, presented in one of two alternating formats (De Par en Par or Póngale Ruedas y Se Lo Lleva). The final car Game is contested by eligible Participants selected at random directly from the studio audience through the Lotería, and others who qualified through an earlier Game. No more than one (1) Vehicle Prize will be awarded per Program, regardless of the number of Games played. No cash substitution for the Vehicle Prize will be permitted unless TelevisaUnivision, in its sole discretion, elects to offer one. Actual value of any prize at the time of award may differ from the ARV stated here; any such difference will not be awarded. All prizes are awarded “as is,” without warranty of any kind, express or implied. Winners are solely responsible for all federal, state, and local taxes, and for all costs of pickup, delivery, transport, registration, and insurance associated with any prize.
7. WINNER VERIFICATION
As a condition of receiving any prize, a winning Participant may be required to: execute an affidavit of eligibility and liability release; furnish government-issued identification (which may include a passport and Social Security number); complete any required IRS tax documentation; reconfirm the citizenship or legal- residency eligibility requirement in Section 2; and, where lawful, execute a publicity release. Failure to timely comply within thirty [30] days of notification may result in disqualification and forfeiture of the prize, and TelevisaUnivision may select an alternate winner or retain the prize.
8. GENERAL GAME CONDITIONS
All decisions of TelevisaUnivision and its designated judges regarding the conduct, scoring, results, and winners of any Game are final and binding and not subject to appeal. TelevisaUnivision may modify, suspend, cancel, or terminate any Game, in whole or in part, at any time and for any reason, including technical failure, suspected fraud, or production requirements, without liability. TelevisaUnivision may disqualify any Participant who tampers with the play, judging, or selection process of a Game, or who engages in conduct that is unsportsmanlike, disruptive, or contrary to the spirit of the Game.
9. RELEASES; CONTENT OWNERSHIP
Participation in any Game is conditioned on execution of the Participant Release, which governs the use of a Participant’s Appearance (as defined in the Participant Release) and is incorporated into these Official Rules by reference. In the event of any conflict between the Participant Release and these Official Rules with respect to the conduct or outcome of a Game, these Official Rules will govern; the Participant Release will otherwise govern the use of a Participant’s Appearance. All content captured, produced, or otherwise created in connection with the Games is owned exclusively by TelevisaUnivision.
10. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Participants release and hold harmless the Released Parties from any and all claims arising from participation in any Game, the taping, or the exploitation or distribution of the Program, including any prize awarded. The Released Parties are not responsible for technical malfunctions, errors in Game administration, or interrupted or lost communications of any kind.
11. DISQUALIFICATION
TelevisaUnivision reserves the right to disqualify any individual who: violates these Official Rules or the Participant Release; provides false, inaccurate, or misleading information, including as to citizenship or residency status; or engages in behavior that harms the integrity or reputation of the Program.
12. PRIVACY
Any personal information collected in connection with these Official Rules will be used in accordance with TelevisaUnivision’s privacy notice, which can be found at https://corporate.televisaunivision.com/privacy- notice/.
14. GOVERNING LAW; DISPUTE RESOLUTION
These Official Rules are governed by the laws of the State of Florida, without regard to its conflicts of law provisions. In the event of any dispute, claim, controversy or disagreement arising out of or relating to the Game, these Official Rules, the administration of the Game, or the determination of winners, Participants and TelevisaUnivision shall first attempt in good faith to resolve the matter informally. If a dispute cannot be resolved informally, or if the delay associated with such efforts would materially prejudice the rights of a party, the dispute shall be submitted exclusively to final and binding arbitration administered by Signature Resolution in accordance with its applicable arbitration rules and procedures. The arbitration shall take place in Miami-Dade County, Florida, and each Participant expressly waives any objection based on venue, forum non conveniens, or personal jurisdiction. The arbitration shall be conducted before a single neutral arbitrator mutually selected by the parties, or if the parties cannot agree, appointed in accordance with Signature Resolution's rules. The arbitrator shall have the exclusive authority to resolve any dispute regarding the interpretation, applicability, enforceability, or formation of these Official Rules, including any claim that all or any portion of these Official Rules is void or voidable. To the fullest extent permitted by law, all disputes shall be resolved solely on an individual basis and not as part of any class, collective, representative, or consolidated action. Discovery shall be permitted in accordance with the procedures established by the arbitrator, taking into consideration the Florida Rules of Civil Procedure.
The arbitrator's fees shall be shared equally by the parties unless otherwise required by applicable law or ordered by the arbitrator. Each party shall bear its own attorneys' fees, expert fees, costs and expenses incurred in connection with the arbitration; provided, however, that the arbitrator may award attorneys' fees, costs, or expenses to a prevailing party upon a finding that the opposing party acted in bad faith or as otherwise permitted by applicable law. The arbitrator's decision shall be final and binding, and judgment upon the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.
15. NOTIFICATION
Winners will generally be determined and announced during the taping. Where post-taping follow-up is required (e.g., for winner verification under Section 8), TelevisaUnivision will use the contact information provided during casting. Failure to respond or comply within the specified timeframe may result in disqualification and selection of an alternate winner.
16. ACCEPTANCE OF TERMS
Participation in any Game constitutes full and unconditional agreement to these Official Rules and to all decisions made by TelevisaUnivision. TELEVISAUNIVISION Univision Networks & Studios, Inc., 9405 NW 41st St, Miami, FL 33178.
